Bankruptcy
Bankruptcy is the federal law that allows individuals to receive a court discharge from unsecured debts. There are two Chapters of bankruptcy which an individual can file. They are Chapter 7 and Chapter 13. Chapter 7 is the simplest form of bankruptcy which allows most people to keep their exempt property (meaning assets that they retain after the bankruptcy process) while discharging their unsecured debts. Chapter 7 is now limited based on a ‘means’ test which looks at median incomes and an individual’s state of residence. It is very important that a capable and qualified attorney assist you since bankruptcy is a financial decision of last resort.
In addition to Chapter 7, many more individuals are able to file a Chapter 13 bankruptcy. Chapter 13 bankruptcy requires a repayment plan of between 36 and 60 months. Chapter 13 bankruptcies are useful in paying arrearages on mortgages and vehicles and also staying Sheriff’s sales on residential real estate.
