Child custody is an emotional issue that separated and divorced parents must confront, while protecting the rights of their children. In addition, the child custody laws may be confusing and may seem unfair. At Daley Zucker, we untangle the legalese and work with clients to assure that their rights are protected. In Pennsylvania, the law does not favor the mother or the father automatically, and each case is considered based on its specific facts. Moreover, child custody cases involve a variety of factors.

In deciding a custody case, when the parties have not agreed on a custody arrangement, the Court must evaluate the best interests of the child and decide on the best arrangement for both physical custody and legal custody. “Physical custody” means actual possession and direct supervision of a child. “Legal custody” refers to the right to make major decisions about the child, including educational, religious and medical decisions.

There are several types of custody arrangements, some examples are:

Joint Custody: Both parents share physical and legal custody.

Sole Physical Custody: The child lives with one parent and is under that parent’s supervision. The other parent may have visitation rights. Visitation refers to the right of the non-custodial parent to visit with the child.

Shared Physical Custody: The child has two residences.
