Drafting Marital Settlement Agreements
Marital separation agreements, or property settlement agreements, are written contracts dealing with the issues arising from a divorce, such as spousal support, child custody, how to divide property, etc. In general, these agreements are designed to settle all or most of the issues in a divorce, including:
- Identification of all children
- The basis for entering into the Agreement
- That the Agreement is voluntary and in the parties’ best interests
- Which issues are being resolved, and which are not
- Child Custody
- Visitation Rights
- Child Support Obligations
- Property Disposition
- Pension Rights
- Insurance Rights, Including Medical Insurance & Life Insurance
- Attorney’s Fees
- Payment of current or future debts
- Releases (of all claims being resolved)
Having a marital separation agreement that includes all or most of these major issues will make your divorce easier. Courts will generally review these agreements to ensure that they are fair. However, you should be careful not to enter into any contract that does not adequately protect your interests because the agreement will bind you for a long time. As a result, you should always have an attorney familiar with these issues review the Agreement to be sure it adequately and fairly protects your rights.
