Pennsylvania Wage Payment and Collection Law Attorneys

The Pennsylvania Wage Payment and Collection Law (WPCL) creates a statutory remedy for employees when an employer violates its legal obligation to pay wages that an employee has earned. The WPCL also protects the rights of an employee whose wages have been withheld after the employee has been terminated. In addition, the law protects employers who properly pay wages, but have legitimate disputes as to the total amount due.

Generally, the earned wages of an employee who has been separated from his or her employer become due and payable no later than the next regular payday. If there is a dispute over the amount of wages, an employer is obligated to provide written notice to the employee as to the amount of wages that are conceded to be due, and must pay that amount. The employee can accept that amount without giving up any rights that might exist to recover the balance.

Some employers try to take advantage of workers, however, and fail to pay them the wages they have earned, or do not pay the proper amounts, hoping that the employees will not pursue the issue.
