Assisting Clients with Powers of Attorney
A Power of Attorney is a document that allows you to appoint a person or organization to handle your affairs if you become incapacitated or unable to handle your own affairs, if you are otherwise unable to handle your affairs for a period of time (such as if you are traveling out of the country), or for a designated purpose. A Power of Attorney specifies the name of the agent, and the powers, or authority, granted to the agent.
Additionally, Powers of Attorney are important estate planning documents, and may at times be as or more valuable than a Will. In addition to a Will, a General Power of Attorney and a Living Will set forth your personal preferences with regard to important decisions during periods of incapacity and end stage medical decisions. For example, if you become seriously ill, having a Power of Attorney allows you to specify who will handle your affairs, saves a lot of money by avoiding the need for your relatives to go into Court and have the Court appoint someone to oversee your affairs, and is a more efficient way of assuring that your wishes are honored.
A General Power of Attorney authorizes the person you designate to act on your behalf in all circumstances, or for a variety of specific situations.
A Healthcare Power of Attorney, also known as an “Advanced Directive for Healthcare” or a “Living Will” allows you to appoint a person to make healthcare decisions for you if you become incapacitated.
You may also want to consider a Special Power of Attorney, which authorizes the person you designate to act on your behalf in specific situations only. The general, special and healthcare Powers of Attorney can all be made "durable,” which means that the document will remain in effect or take effect if you become unable to handle your affairs because of a medically-certified physical or mental impairment.
