Most employment in Pennsylvania is “at will,” which means that an employer can generally terminate or fire an employee at any time for any reason, and an employee can also resign at any time for any reason. On the other hand, some employees are covered by employment agreements, union collective bargaining agreements or have other rights given to them by their employers or by the state and federal law.

When an employee quits, is laid off or fired, he or she generally has limited rights. Despite this, there are circumstances when an employer might be wise to offer a severance package in exchange for an employee signing a Severance and/or Separation Agreement that waives certain rights and releases the employer from further liability.

Severance and/or Separation Agreements, or Termination Agreements, generally outline the terms of the employee’s termination, such as a layoff, and provide certain financial benefits to an employee, who generally give up their rights to sue. Some Severance Agreements may include non-compete and non-disclosure clauses.

In order to avoid the possibility of a lawsuit, it is important for employers to have a Severance Agreement that is well drafted by an experienced attorney. On the other hand, if you are an employee being offered a Severance Agreement, you need to be careful not to give up rights that are more valuable than the severance package being offered.
